Service Description

Montana Pest Control provides residential, commercial, and agricultural pest management services throughout the state of Montana. Our services include, but are not limited to, inspection and identification of pest infestations, integrated pest management programs, chemical and non-chemical treatment applications, wildlife exclusion, rodent control, insect management, and ongoing monitoring and maintenance plans. Specific treatment methods, products, and service schedules are determined based on factors including but not limited to the type of pest, severity of infestation, property conditions, weather, and applicable regulatory requirements. All services are performed by licensed technicians in accordance with Montana Department of Agriculture regulations and federal guidelines governing pesticide application and pest control practices. We reserve the right to modify, discontinue, or decline any service at our sole discretion where safety concerns, regulatory restrictions, or other operational considerations warrant such action.

No Guarantee or Warranty

Montana Pest Control does not guarantee complete elimination of pests from any treated property. Pest control results vary based on numerous factors outside our reasonable control, including but not limited to pest biology and reproduction rates, environmental conditions, structural integrity of buildings, neighboring property conditions, and client compliance with recommended sanitation and exclusion measures. We do not warrant that treatments will prevent future infestations or that pests will not return after service completion. Any follow-up services, retreatments, or warranties offered in writing are limited to the specific terms and timeframes expressly stated in a separate service agreement. No oral representations, promotional materials, or advertising content shall create any warranty not expressly set forth in a signed written contract. Client acknowledges that pest management is an ongoing process requiring cooperation and that absolute eradication may not be achievable in all circumstances.

User Responsibilities

Clients must provide accurate information regarding pest issues, property conditions, and any known health conditions of occupants or pets that may affect service safety. Prior to scheduled treatments, clients are responsible for preparing the property as instructed, including but not limited to removing or covering food items, securing pets, clearing access to treatment areas, and notifying us of any sensitive equipment, aquariums, or organic gardens. Clients must comply with all post-treatment instructions provided by our technicians, including re-entry timelines, ventilation requirements, and cleaning restrictions. Failure to follow these instructions may reduce treatment effectiveness and void any retreatment obligations. Clients must promptly report any adverse observations or recurring pest activity within the specified notification period. Clients are responsible for maintaining structural integrity, implementing recommended sanitation practices, and addressing conducive conditions that attract pests. Access to the property must be provided at scheduled times; missed appointments may incur additional fees.

Limitation of Liability

To the maximum extent permitted by applicable law, Montana Pest Control and its owners, employees, agents, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to our services, including but not limited to property damage, loss of profits, business interruption, personal injury, or allergic reactions, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. Our total cumulative liability for any claims related to services performed shall not exceed the total amount actually paid by client for the specific service giving rise to the claim. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. Client assumes all risk of damage to personal property, landscaping, or structures that may result from treatment applications, excluding only damage caused by our gross negligence or willful misconduct as determined by a court of competent jurisdiction.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, photographs, videos, written materials, treatment protocols, and proprietary methodologies associated with Montana Pest Control are the exclusive intellectual property of Montana Pest Control or its licensors. Clients and website users are granted no license or right to use, reproduce, distribute, modify, create derivative works from, or display any such intellectual property without our prior written consent. Unauthorized use of our name, logo, or service marks for competitive purposes, false endorsement, or commercial exploitation is strictly prohibited and may constitute trademark infringement and unfair competition under Montana and federal law. Any feedback, suggestions, or testimonials provided to us may be used for marketing purposes without compensation. Technical information and treatment specifications disclosed during service remain our confidential trade secrets.

Governing Law

These Terms of Service and any disputes arising from or relating to services provided by Montana Pest Control shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of laws principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Yellowstone County, Montana, and client hereby submits to the personal jurisdiction and venue of such courts. Client waives any objection to venue or jurisdiction based on inconvenience or lack of personal jurisdiction. The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs. If any provision of these terms is held invalid or unenforceable under Montana law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Changes to Terms

Montana Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Material changes will be indicated by updating the "Last updated" date at the top of this document. Continued use of our services or website following any such changes constitutes client's acceptance of the revised terms. We encourage clients to review these terms periodically. In the event of a material change affecting active service agreements, we will make reasonable efforts to provide direct notice through contact information on file. However, client bears responsibility for maintaining current contact information and reviewing these terms regularly. No waiver of any provision shall be effective unless in writing signed by an authorized representative of Montana Pest Control. Failure to enforce any right shall not constitute a waiver of future enforcement.
